These terms and conditions comprise the contract between you and Expert Kilimanjaro Trails. When you use this website or make a booking online, you are agreeing to be bound by the booking terms and conditions.
Booking Terms
Group Booking
When booking for a group, one person (group leader) should make the booking on behalf of everyone else. The group leader must be at least 18 years, must have the consent of the other group members, and will also ensure that all payments due for the tour reach us at Expert Kilimanjaro Trails on time.
By booking through the group leader, all group members agree to be bound by the terms and conditions specified on this page.
Group leaders are responsible for sharing any information we provide with the group.
Individual Booking
When booking for yourself, you must fill out and submit our online booking form; by doing this, you agree to be bound by the terms specified on this page.
You also agree to ensure that all payments for your tour reach us at Expert Kilimanjaro Trails on time.
Payment & Confirmation of Booking
Your tour will be confirmed when we issue a confirmation message. The issuance of the confirmation establishes a legal agreement between you and Expert Kilimanjaro Trails. We send the confirmation message to the person who makes the booking.
Review the confirmation message as soon as it reaches your inbox; if any detail appears incorrect, notify as soon as possible cause it may not be possible to make amends later.
For Expert Kilimanjaro Trails to confirm your booking, you must pay a deposit of 30% of the total cost. The 30% deposit is due within 14 days from the day you make the booking. The remaining balance is due 30 days before the first day of your trip. If Expert Kilimanjaro Trails does not receive the remaining balance by the due date, we will cancel the booking; in such circumstances, the deposit is not refundable.
Prices
The tour prices quoted are valid for the dates specified only. Until the full payment is received, the client will be liable for any increases in government taxes, hotel rates, airport taxes, fuel surcharges, or exchange rate increases. Tour prices are based on the total package and include only the items specified in the booking document and itinerary sent to the client.
Items Not Included in Your Tour Price
The following items are not included in the tour price:
- Expenses for optional activities (or add-ons)
- Expenses for personal spending e.g gift purchases, etc
- Drinks (Alcoholic and soft drinks)
- Visa fees
- Tips or gratuities
- Travel Insurance
Cancellations by the Client or Transfer of Tour
If the client can not make the trip, they can transfer their trip to a different date in the future; however, in some circumstances, Expert Kilimanjaro Trails reserves the right to reject trip transfers. When a trip transfer is approved, the new trip must happen within one year of the original trip date.
Cancellation requests should be made in writing (via email), and the following refund charges conditions apply.
- 50% refund if the cancellation happens 60-30 days before the first day of the trip
- 80% refund if the cancellation is within 60 or more days before the first day of the trip
- No refund if the cancellation happens less than 30 days before the first day of the trip
If the client abandons a trip after it has begun, there shall be no refunds; any additional costs incurred by Expert Kilimanjaro Trails due to trip abandonment shall be billed to the client.
Cancellation by Expert Kilimanjaro Trails
Sometimes, we face circumstances beyond our control; in such cases, we may have to cancel a client’s booking.
Situations that can lead to a cancellation include but are not limited to war, terrorism, hostilities, riots or political unrest (or the threats of any of these), industrial disputes, natural disasters, adverse weather conditions, or the withdrawal of (or significant interference with) travel or accommodation facilities.
If cancellation is inevitable, we will notify you of the cancellation as soon as it is practically possible. We will also offer you a similar tour in the future; if the offer is not acceptable, we will refund all of the monies you paid.
Delays
We will not be liable for any claims or additional expenses incurred by the client due to delays or disruptions in planned itineraries caused by circumstances beyond our control. Examples of such situations include flight delays, wars, strikes, weather, or acts of God.
Insurance
We require you to take adequate insurance against all risks that may result from international travel and safari activities.
Unscheduled Extensions or Trip Add-ons
If a client wants to purchase add-ons or extend their trip, all arising costs will be the client’s responsibility.
Medical Conditions
Clients are responsible for assessing their suitability and capability to participate in our tours. All clients should consult their physician regarding their fitness to participate in the activities highlighted in our tour itineraries.
We also advise our clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of their travel with us. We do not provide medical advice.
Force Majeure
We cannot accept any liability or pay any compensation for delays or lack of performance caused by force majeure. Force Majeure means any event we have no control over; even in circumstances where we took all due care, the event could not have been avoided or foreseen.
The situations include war, or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural disaster, adverse weather conditions, fire, and other events outside the company’s control.
Marketing
We reserve the right to use any photographs or videos of you taken by our guides during a tour with Expert Kilimanjaro Trails. You also give us the right to retain ownership of the said photos and videos.
Disputes
If you have any cause of complaints while traveling, you must immediately bring it to the attention of Expert Kilimanjaro Trails. You agree to inform the head guide or other designated company representative at the earliest opportunity.
We will not be liable for complaints not brought to our attention on time and with sufficient notice for us to resolve or attempt to resolve. Any complaint must reach us in writing within 30 days of the last day of your tour.
General Terms
Personal Information
Your submission of personal information through the store/website is governed by our Privacy Policy.
Prohibited Use
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, national, regional or state regulations, rules, laws, or local ordinances; (d) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of this website or of any related website, other websites, or the Internet; or (e) to collect or track the personal information of others. We reserve the right to terminate your use of the website for violating any of the prohibited uses.
Indemnification
You agree to indemnify, defend and hold harmless Expert Kilimanjaro Trails and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third party.
Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
